By registering and attending this event, you consent to be photographed, filmed and/or otherwise recorded. Your entry constitutes your consent to such photography, filming and/or recording and to any use, in any and all media throughout the universe in perpetuity, of your appearance, voice and name for any purpose whatsoever in connection with media products created at 8 Miles for Water. You understand that all photography, filming and/or recording will be done in reliance on this consent given by you by attending this event. All material captured is for the positive promotion of this event.

Waiver, Release, & Assumption of Risk *

In consideration of me being permitted to participate in the activity of exercise and training, hereinafter referred to as the "Activity", at the locations of the event 8 Miles a Journey for Clean Water hereinafter referred to as the “Premises”, I agree: 1. I understand the nature of the Activity and believe I am qualified to participate in the Activity. I further agree and warrant to participate within my abilities and that if at any time I believe the Activity to be beyond my abilities or the conditions to be unsafe, I will immediately discontinue further participation in the Activity. 2. I understand that: (a) The Activity involves risks and damages of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH and there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, hereinafter referred to as the "Risks"; (b) the Risks may be caused by my own health, conditioning, abilities, actions or inactions, the actions or inactions of others participating in the Activity or at the Premises, the condition of the Premises or in which the Activity takes place or both, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES incurred as a result of my participation in the Activity. 3. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS 8 Miles for Clean Water, hereinafter referred to as "Owner", Owner's respective administrators, directors, agents, family members, volunteers and employees, other participants, organizations, businesses, any sponsors, any advertisers, and if applicable, other owners and lessors of the Premises on which the Activity takes place (each considered one of the "Releasees" herein) FROM ALL LIABILITY TO ME (OR MY PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, OR NEXT OF KIN) FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF ANY PERSONAL INJURY, DEATH, AND/OR OTHER DAMAGE I MAY SUFFER ARISING OUT OF OR RELATED TO THE ACTIVITY, WHETHER CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" (INCLUDING NEGLIGENT RESCUE OPERATIONS) OR OTHERWISE (other than if caused by their reckless or willful misconduct) and further agree that if, despite this release, I, or anyone on my behalf makes a claim against any of the Releasees named above, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. 4. I understand that I have the opportunity to bargain for the elimination of this Waiver, Release and Assumption of Risk, and that such elimination will result in a substantially higher participation fee. Therefore, I have elected to execute this Waiver, Release and Assumption of Risk and to waive my opportunity to bargain for its elimination. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
